The present petition has been preferred for quashing of the order dated 10.01.2019 passed by learned ACJM-IV, Gaya in connection with Complaint Case No. 244 of 2018,
Patna High Court CR. MISC. No.13374 of 2021(2) dt.21-04-2022 2/2 whereby and whereunder the learned ACJM-IV, Gaya has taken cognizance under Sections 498A, 323, 504 and 506 of the Indian Penal Code against the petitioners.
Prosecution story in brief is that a complaint was filed by the opposite party no.2 Smt. Suryamanti Devi against her husband and all the closed relative of her husband namely Kamlesh Kumar who is petitioner no.1 in the present application. Allegation is of demand of dowry and torture for the same. It would be in the interest of justice to put an end to the matrimonial strain between the parties. Both the parties are directed to appear before the trial court for getting their statement recorded and if there is any possibility of mediation, the matter be referred to the District Mediation Centre and the District Mediator is expected to submit its report within a period of three months to the trial court.
With the above observation, the present application stands disposed of.
