JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The statement of victim has been recorded under section 164 of the Cr.P.C in which she stated that this petitioner took her by a vehicle but she has nowhere stated in her statement that any force was used by the petitioner. Moreover, petitioner is in jail custody since 01.07.2014.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, West Muzaffarpur in connection with Saraiya P.S. Case No. 238 of 2014.
