JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-01-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 366A of the Indian Penal Code and Section 8 Protection of Children from Sexual Offences Act.
According to the prosecution case itself, it was coaccused Md. Asif, who is said to have kidnapped the informant's daughter. The petitioner happens to be the father of the aforesaid co-accused Md. Asif.
No doubt, the victim has not been recovered as yet nor co-accused Md. Asif could be arrested but taking note of this fact that the petitioner is in jail custody since 31.08.2018, let the petitioner, above named, be released on bail on furnishing
Patna High Court Cr.Misc. No.209 of 2019(2) dt.17-01-2019 2/2 bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Sheikhpura in connection with Sheikhpura P.S. Case No. 581/2018 (POCSO Case No. 35/2018).
