This application for grant of regular bail arises out of Udwantnagar P.S. Case No. 333 of 2019 registered for the offence punishable under Sections 302 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
I have perused the case diary, from which it transpires that the petitioner's involvement in commission of offence has been found to be direct. His confessional statement has been recorded by the police.
Mr. Ramakant Sharma, learned Senior Counsel appearing on behalf of the petitioner, has submitted that the petitioner's name was disclosed by someone else to the informant, on the basis of which he has been named in the First Information Report.
Patna High Court CR. MISC. No.1283 of 2020(4) dt.05-06-2020 2/2 Be that as it may, considering the materials collected in course of investigation, I am not inclined to grant the petitioner privilege of regular bail.
This application is accordingly rejected.
The petitioner shall, however, be at liberty renew his prayer for bail, if there is no substantial progress in trial within one year from today.
