Heard learned counsel for the parties.

This application for grant of regular bail arises out of Pusha P.S. Case No. 23 of 2020, disclosing offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner had earlier approached this Court for grant of regular bail, which was rejected by this Court by an order dated 23.06.2020 passed in Cr. Misc. No. 19816 of 2020 with a liberty to renew his prayer for bail after six months, if there was no substantial progress in the trial. Allegedly, 194.670 liters of foreign made liquor was recover from a car, which was in petitioner's possession.

Patna High Court CR. MISC. No.13553 of 2021(2) dt.07-07-2021 2/2 Mr. D. K.Sinha, learned senior counsel appearing on behalf of the petitioner has submitted that there is no substantial progress at the trial and that the petitioner has no criminal antecedent at all.

Considering the aforesaid submission and the fact that the petitioner is in custody since 27.03.2020, this application is allowed.

Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise, Samastipur in Pusha P.S.
