The petitioner seeks bail in a criminal prosecution registered under Sections 363, 365 and 366 of the Indian Penal Code.
Taking into consideration the fact that the petitioner is specifically named in the FIR vide Annexure-1 as an accused and he is alleged to have committed the crime of kidnapping of the minor daughter of the informant, and also taking into consideration the fact that the alleged victim has not been recovered till date, this Court is not inclined to accede to the prayer made on behalf of the petitioner for grant of bail at this stage. Accordingly, his prayer for bail in connection with Ara Nawada P.S. Case No.495 of 2014 pending in the court of learned C.J.M., Bhojpur at Ara is rejected for the present. However, if the victim girl is recovered and her statement under Section 164 Cr.P.C. is recorded, then the petitioner shall be at liberty to renew his prayer for bail before the learned court below.
