The petitioner apprehends his arrest in connection with Raghopur P.S. Case No. 27 of 2015, registered for the offences punishable under Sections 147, 148, 149, 307, 379, 427, 504 and 506 of the Indian Penal Code and Sections 25(1-b)A, 26, 27 and 35 of the Arms Act.
Allegedly, on receiving information that firing and cross-firing are going on between two groups. The police went there and arrested nine persons and from possession of co-accused cartridges were recovered. It is alleged that the petitioner succeeded in fleeing away.
Submission is of false implication and that only on
Patna High Court Cr.Misc. No.14281 of 2017 (2) dt.03-05-2017 2/2 suspicion the petitioner has been roped, there is no recovery from the possession of the petitioner or from his house. In this case similarly situated other co-accused Karu Rai and Ors. have been allowed pre-arrest bail vide Cr. Misc. No. 35898 of 2015 and further Golak Ray has been allowed pre-arrest bail vide Cr. Misc. No. 40022 of 2015 and, as such, the petitioner deserves sympathetic consideration.
The learned A.P.P. fairly submits that other coaccused have been allowed pre-arrest bail. In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Raghopur P.S. Case No. 27 of 2015, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
