JUSTICE SANDEEP KUMAR ORAL ORDER 12-05-2022 At the very outset, learned counsel for the petitioners submits that the present application has become infructuous on behalf of petitioner No. 1 and seeks permission to withdraw the same.

It is, thus, dismissed as withdrawn as having become infructuous on behalf of the Petitioner No. 1 (Ram Kewal Paswan).

Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection

Patna High Court CR. MISC. No.3434 of 2022(2) dt.12-05-2022 2/2 with Sonbarsa P.S. Case No. 85/2018 registered for the offences punishable under Sections 363/366A of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that the petitioner No. 2 is the husband of the alleged victim and the victim and the petitioner are staying together and they got children also and they have entered into a compromise. Considering the facts and circumstances, the present anticipatory bail application is allowed.

Accordingly, let the petitioner No. 2, above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Sonbarsa P.S. Case No. 85/2018, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. At the time of accepting bail bond, the Court below will verify the fact of compromise and if it is found genuine, the bail bond of the petitioner is accepted and if is not found genuine, the petitioner shall be arrested.
