JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2019 This is an application for grant of anticipatory bail in connection with Gaya Mufassil P.S. Case No. 523 of 2016, disclosing offences under Sections 147, 148, 149, 341, 323, 325, 379, 506 and 307 of the Indian Penal Code.

Allegation against the petitioner is of assault to the informant by butt portion of pistol.

Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and there is case and counter case between the parties. Further submission is that just to make the case serious, the allegation of assault with butt portion is made and petitioner has no criminal antecedent.

Having heard both sides, considering the above

Patna High Court Cr.Misc. No.1388 of 2019(2) dt.22-01-2019 2/2 submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Gaya Mufassil P.S.
