JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-03-2019 This is an application for grant of anticipatory bail in connection with Gogri P.S. Case No. 183 of 2013, disclosing offences under Sections 341, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioners is of firing causing injury on the hand of the informant.

Submission of learned counsel for the petitioners is that injury report shows only blood clotting on the hand of the informant and he does not produced the X-Ray report and further para nos. 44 to 47 of the case diary disclosed that the witnesses have not heard the sound of firing and no specific allegation of firing has been attributed against any of the

Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for anticipatory bail of the petitioners stating that there is allegation of firing against the petitioners.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Gogri P.S. Case No. 183 of 2013, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Amjad/- U T
