The petitioner seeks bail in a case registered under sections 457, 380, 308 of the Indian Penal Code. The informant alleged that a theft was committed in his house and one thief was apprehended who disclosed his name Shamim, He also disclosed the name of Md. Rafi , Laloo and Sanjay.

Learned counsel for the petitioner submits that petitioner is innocent and his name has been figured in the confessional statement of co-accused but nothing has been recovered from the possession of the petitioner. The petitioner has got no criminal antecedent and he is in jail since 02.10.2014. Having considered the fact that the name of
