Mr. N.H Khan SC-1 ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 15-07-2022 Heard learned counsel for the petitioner and learned counsel for the State.

This writ application has been preferred seeking a direction to the respondent authorities to conduct proper investigation in Chandauti P.S. Case No. 114 of 2016 dated 10.04.2016 under Sections 419/420/467/468/379/120B IPC. Petitioner has also prayed for taking proper steps for arrest of the accused persons in the said case.

A counter affidavit has been filed in this case. The counter affidavit seems to have been filed on or about

Patna High Court CR. WJC No.460 of 2017(3) dt.15-07-2022 2/3 19.06.2017. According to the counter affidavit, the investigation of the case was still going on regarding the verification of the fake lady and the land related documents in the case. The case was mainly pending for verification on those points. At this stage, it is not known to either parties as to what is the stage of the investigation. Learned counsel for the petitioner submits that till date, the investigation is pending. Be that as it may, the present writ application is being disposed of with a direction to the Senior Superintendent of Police, Gaya (respondent no.

4) to review the matter at his own level within a period of four weeks from today and in case it is found that the investigation of the case is still pending, he will not only take appropriate steps by deputing a competent investigating officer to complete the investigation and submit a report but would also take a view as to why the investigation has remained pending so far and whether this has happened due to laxity on the part of the I.O. in taking steps. If the investigation stands concluded and a police report has been submitted in the learned court below, the learned court below shall proceed in accordance with law.
