Although the informant claims that he identified the petitioner at the time of alleged occurrence but neither petitioner was caught on the spot nor anything was recovered from his conscious possession. Moreover, investigation against the petitioner has already been completed.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-Vth, Biharsharif, Nalanda in connection with Harnaut ( Telemar) P.S.case No. 371 of 2015.
