"That this is an Application for issuance of the appropriate writ / writs, order / orders or direction / directions to the respondent authorities for preparation of the panel of petitioners who are the D.D.T. Sprayer workers and finalised the panel for the appointment of the petitioners on the Group IV Posts after giving the age relaxation in accordance with the guide line and Policy of State Government and order of this Hon'ble Court and also for directing the respondent authorities to take Subsequent step for obserption / appointment of the petitioners on the vacant class IV Post Under the District." Issuance of writ of mandamus for consideration of grievance of the petitioner stated in the present petition, there is no demand before the competent authority so as to issue a direction for consideration of their grievances. Accordingly, petitioners have not made out case.

9/9 Thus, the writ petition stands dismissed with reference to Apex Court decision in the case of Mani Subrat Jain Vs. State of Haryana & Ors. Reported in A.I.R. 1977 SC 276 wherein it is held that statutory right read with demand before the competent authority is mandate for the purpose of invoking Article 226 of the Constitution insofar as, writ of mandamus.

In the absence of the aforesaid ingredients, the present petition stands dismissed, reserving liberty to the petitioners to approach the concerned authority in making representation/application with material information. If, such application/representatiton is submitted to the competent authority within a period of eight weeks from today, the competent authority is hereby directed to consider the grievance of the petitioner at the earliest.
