The petitioner seeks bail in anticipation of his arrest in connection with Surajgadha P.S. Case No. 267/2019 instituted for the offences under Sections 341, 323, 307 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
The accusation against the petitioner is of having opened fire at the informant and also assaulted him for the suspicion that he had got the vehicle of the informant which was loaded with sand, caught by the police.
The learned counsel for the petitioner has
Patna High Court CR. MISC. No.13093 of 2021(2) dt.03-01-2022 2/2 submitted that there is no gunshot injury on the informant. The injuries suffered by him are simple in nature which could have been caused in any other transaction.
Regard being had to the afore-stated facts, namely, the dispute between the parties with respect to suspicion about the informant having been falsely implicated at the hands of the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Surajgadha P.S. Case No. 267/2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure (Ashutosh Kumar, J) sunilkumar/- U T
