2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 191( 2 ), 190, 127 ( 1 ) , 115 ( 2 ), 303 ( 2 ), 329 ( 4 ) , 109, 352, 351 ( 2 ) of Bharatiya Nagarik Sanhita ( BNS ).

The prosecution case in brief, is that on the alleged date and time of occurrence , informant alongwith her husband was sitting at her door and in the meantime this petitioner alongwith other co-accused persons came to the door of informant and asked about her granddaughter then informant asked about the matter, upon which co-accused Satyabir Kumar and this petitioner armed with iron rod and lathi assaulted the informant upon her head due to which she sustained injury on

No.1760 of 2025(2) dt.11-02-2025 2/3 her head and in the meantime Prince Kumar snatched gold chain worth Rs. 75,000/- from the neck of the informant and coaccused Dhanwati Devi, Shivkumari Devi and Yogendra Paswan entered in the house of informant and took away the box in which lacs of rupees and Asharfi were kept. It is further alleged that this petitioner and co-accused Satyabir demanded Rangdari and when informant raised alarm, nearby people gathered and saved the informant.
4. It is submitted on behalf of the petitioners that both parties are agnates and due to trivial issue a quarrel took place between the parties in which both sides sustained injury . The present case is counter blast of Sasaram ( Muff. ) P S Case No. 361 of 2024 under Sections 191( 2 ), 190, 127 ( 1 ) , 115 ( 2 ), 303 ( 2 ), 109, 352, 351 ( 2 ) of BNS and under Section 27 of Arms Act lodged by mother of petitioner against the informant and her family members and the instant case has been lodged by the informant only with a view to save her skin from the aforesaid case . Petitioner claims clean antecedent. 5 . Learned counsel for the State opposed the bail petition .
6 Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event
Patna High Court CR. MISC. No.1760 of 2025(2) dt.11-02-2025 3/3 of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Sasaram Rohtas in connection with Sasaram ( Muff. ) P.S. Case No. 360 of 2024 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
