JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-02-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 384, 386, 34 of the Indian Penal Code.
The prosecution case is that the informant being senior manager of Punjab National Bank was going with his cashier Brajesh Kumar when they were caught and robbed by the miscreants when co-accused Anil Kumar and Dhiraj were identified. Subsequently the informant came to know that six persons have entered into the house of one Priyanka Devi. The informant along with police personnel reached there and on query they came to know that six persons were Anil Kumar, Rahul Kumar, Bittu Kumar, Dhiraj, Chandrabanshi and the petitioner Sanjit Kumar.
It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been
Patna High Court Cr.Misc. No.7299 of 2016 (2) dt.18-02-2016 2/2 levelled. The Priyanka Devi named all the six accused persons since she was on inimical term with co-accused Anil Kumar being his step brother. It is further submitted that investigation against the petitioner is still pending.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail till conclusion of the investigation on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Kutumba P.S. Case No. 41 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. The bail bonds of the petitioner will be accepted on filing affidavit to the effect that petitioner will cooperate in the investigation.
Non-cooperation in the investigation will give liberty to the prosecution to file appropriate application for cancellation of bail of the petitioner. (Dinesh Kumar Singh, J) Shageer/- U T
