====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 13-03-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Ramgarhwa P.S. Case No. 245 of 2018, instituted for the offence under Section(s) 452, 354 and 354B of the Indian Penal Code, 1860. It is alleged in the written report that on the date of occurrence when the informant was sleeping in her room, petitioner after entering into the room attempted to commit illegal act with her.

In the statement recorded under Section 164 Cr. P.C. the informant has given different story than the statement in the written report.

Counsel for the petitioner submits that petitioner is

Patna High Court CR. MISC. No.951 of 2019(3) dt.13-03-2019 2/2 elder brother of husband of the informant. The instant case has been filed due to partition dispute between the parties. He further submits that parties have entered into compromise in the court below, in support of which, a photocopy of compromise petition has been enclosed as Annexure-3. Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Raxaul, in connection with Ramgarhwa P.S. Case No. 245 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
