2. The petitioner seeks regular bail in connection with Sonbarsa P.S. Case No. 326 of 2024 registered for the offence under Sections 317(5) of the BNS.
3. As per the prosecution case, petitioner is said to have been caught with stolen motorcycle.
4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 20.10.2024 and claims clean antecedent.
5. Learned A.P.P. has vehemently opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances,
Patna High Court CR. MISC. No.8458 of 2025(2) dt.06-03-2025 2/2 this application for regular bail is allowed.
7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Sitamarhi/concerned Court below in connection with Sonbarsa P.S. Case No. 326 of 2024 subject to condition that:- i). Before accepting the bail-bonds of the petitioner, the Court below will verify the antecedent of the petitioner. If the petitioner is found having clean antecedent, then the bail-bonds of the petitioner shall be accepted. If the petitioner is found having criminal antecedent(s), then his bail-bonds shall not be accepted by the court below.
ii). Since the petitioner is from Nepal, the bail bonds shall be furnished by the local bailors. (Sandeep Kumar, J) Shishir/- U T
