The petitioner has renewed his prayer for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 21.3 litres of liquor was recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 4.9.2021 (Annexure-1) passed in Cr. Misc. No. 20483 of 2021 giving liberty to the petitioner to renew his prayer for bail after completing one year in custody. The petitioner is in custody since 23.12.2020.

Heard learned APP for the State.

No.3419 of 2022(2) dt.02-02-2022 2/2 Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the liberty granted in the aforesaid order of rejection dated 4.9.2021 and the petitioner having remained in custody for more than 1 year, the petitioner is directed to be enlarged on bail in connection with Rampur P.S. Case no. 407 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge II- cum - Special Judge, Excise, Gaya.
