Petitioner seeks bail in a case registered under sections 328 395 and 412 of the Indian Penal Code.
Petitioner is not named in the first information report but from perusal of the impugned order, it would appear that the petitioner confessed his guilt and except confessional statement, there appears to be nothing against the petitioner. Furthermore, the impugned order goes to show that recovery of looted truck has been made on the basis of confessional statement of other accused.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Bhagalpur in Shahkund (Sajour) P.S.
