JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2019 Petitioners apprehend their arrest in connection with Chutiya (Yadunathpur O.P.) P.S. Case No. 33 of 2018 registered for the offences punishable under Sections 363, 365 and 379/34 of the Indian Penal Code.

Allegation against one Rimbha Devi is that she has taken daughter of the informant and it is also alleged that villagers had seen Rimbha Devi and other accused persons going along with daughter of informant.

Submission of learned counsel for the petitioners is that statement of the girl has been recorded under Section 164 Cr.P.C. (Annexure-2) and she has not named these petitioners. Heard learned APP also.

Having heard both sides and in the facts and

No.1530 of 2019(2) dt.23-01-2019 2/2 circumstances, let petitioners, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Smt. Aditi Gupta, Additional Chief Judicial Magistrate-I, Dehri-onSone, District Rohtas, in connection with Chutiya (Yadunathpur O.P.) P.S. Case No. 33 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
