The petitioner is named in the first information report and the informant claims that he had seen the petitioner as well as other FIR named accused, fleeing from the place of occurrence, brandishing the fire-arms in their hands.

Except the aforesaid materials, there appears to be nothing against the petitioner and moreover, the enmity due to land dispute, is admitted in the first information report itself. Considering the aforesaid facts and circumstances of the case as well as submission of the parties, let the petitioner, named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each
