JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 5.12.2014 in a case registered for the offences punishable under Section 7 of the E.C. Act.

The Block Supply Officer, Madhepura inspected one truck and seized 401 bags of rice. The petitioner was driver of the loaded truck who disclosed that the rice belonged to Sanjay Kumar Gupta.

It is submitted by learned counsel for the petitioner that Sanjay Kumar Gupta claimed the rice to have been purchased from a rice mill owned by Raman Kumar Sah and the rice was being transported for sale.
