Petitioner apprehends arrest in connection with Ranitalab P.S. Case No. 249 of 2019 registered for the offences under Section 341, 448 and 354 of the Indian Penal Code and Section 12 of the Protection of Children from Sexual Offences (POCSO) Act, 2012.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the instant case. Further submission is that the petitioner has not committed the alleged offence and this FIR has been filed by the informant to pressurize the petitioner to withdraw the earlier case. It is also submitted that the petitioner has no criminal antecedent.

Patna High Court CR. MISC. No.3075 of 2020(4) dt.24-02-2023 2/2 Learned Additional Public Prosecutor appearing for the State vehemently opposes the prayer of bail and submits that there is direct allegation against the petitioner of molesting the sister-in-law of the informant aged 13 years. He therefore, submits that petitioner does not deserve to be enlarged on anticipatory bail.

Considering the nature of allegation levelled against the petitioner and the submissions advanced on behalf of the parties, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner. His prayer for bail is accordingly rejected.
