The petitioners in this case are seeking anticipatory bail in connection with Chandan (Anandpur) P.S. Case No.124 of 2019 registered for the offences punishable under Sections 328 and 302/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. Learned counsel submits that the petitioners have committed no offence as alleged in the FIR.

Learned APP for the State is present and has opposed the prayer for anticipatory bail of the petitioners.

No.1711 of 2020(2) dt.14-01-2020 2/3 Considering the facts and circumstances of the case and the submission of learned counsel for the petitioners that these petitioners are the elder brother and his wife and that husband of the deceased is already in custody, the deceased had got vacant land for residence purpose in the partition which took place between her husband and the petitioner no.1 on which she was not happy and further submission that the deceased had committed suicide by consuming poison and after noticing the submission a learned coordinate Bench of this Court has granted anticipatory bail to the father-in-law Nathi Yadav in Cr.Misc.No.

72288 of 2019, copy of which is Annexure-2 to the present application, let the petitioners in the event of their arrest or surrender within a period of four weeks from today, be enlarged on bail on furnishing of bail bonds of Rs. 15,000/- (fifteen thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Chandan (Anandpur) P.S. Case No.124 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. i.e.

(i) a condition that the person shall make himself available for interrogation by a police officer as and when required;
