The petitioner has questioned the legality of the order passed by the Principal Judge, Family Court, Patna by which the Principal Judge, Family Court, Patna allowed the petition of the respondent for amendment.
No one appears on 28.02.2017 on behalf of the petitioner and consequently this civil miscellaneous case was dismissed on 28.02.2017 for non-prosecution. The petitioner-wife filed restoration petition being M.J.C. No.706 of 2017 and the same was allowed vide order dated 13.12.2017. Consequently, the present civil miscellaneous case was restored to its original file and ordered to be placed under the heading for orders but no one
Patna High Court C.Misc. No.355 of 2017 (4) dt.16-02-2018 appears on behalf of the petitioner on 12.02.2018 and even today, no one appears.
From perusal of the impugned order itself it is evident that the learned Principal Judge allowed the amendment petition with regard to the facts subsequent to the filing of the matrimonial case.
Therefore, I do not find any illegality or apparent jurisdictional error in the order impugned. Accordingly, this civil miscellaneous petition is dismissed.
