Learned counsel for the petitioners undertakes to remove the defects within three weeks. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 147, 148, 149, 448, 342, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code.
It is submitted by learned counsel for the petitioners that petitioners are innocent and have been falsely implicated in this case. He submits that there is general and
Patna High Court CR. MISC. No.3097 of 2022(2) dt.12-07-2022 2/2 omnibus allegation levelled against the petitioners. He submits that there is no specific allegation against the petitioners. There is specific allegation against co-accused Kanhaiya Kumar. He submits that the injury found upon the victim is simple in nature. He further submits that petitioners have no criminal antecedent as stated in para-3 of this application. Learned APP for the State opposes the prayer for bail and submits that the petitioners are also involved in the present case.
Considering the nature of allegation, I am not inclined to enlarge the petitioners on bail. Accordingly, their prayer for anticipatory bail is rejected in connection with Town P.S. Case No. 474 of 2021.
