JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-01-2020 This is an application for grant of anticipatory bail in connection with Panjawara P. S. Case No. 86 of 2019 disclosing offences under Sections 341, 323, 307, 504/34 of IPC. So far petitioner no.1 is concerned, there is general allegation against him and other co-accused persons of assaulting the informant and so far petitioner no.2 is concerned, there is allegation of assault by spade and the impugned order shows that injury is grievous in nature.

Submission of the learned counsel for the petitioners is that so far petitioner no.1 is concerned, there is general allegation and a compromise has been reached between the parties. They have no criminal antecedent.

Having heard both sides, considering the above submissions, so far petitioner no.1 is concerned, let the petitioner no.1, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-I, Banka, in connection with Panjawara P. S. Case No. 86 of 2019.

So far petitioner no.2 is concerned, I am not inclined to grant privilege of anticipatory bail to him. He has to surrender and pray for regular bail, which will be considered on the basis of the submissions as made as well as materials available on the record, and if possible to be disposed of on the same day.
