ANJANA MISHRA ORAL ORDER 20-01-2020 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 17.11.2019 in connection with Khutauna P.S. Case No.116 of 2019, G.R. No.2197 of 2019 registered for the offence under Sections 279, 337, 338, 272, 273, 353 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2018. Learned counsel for the petitioner submits that the petitioner was merely travelling in the vehicle, which was intercepted and from the same, certain quantity of liquor was recovered. It is submitted that the petitioner had no knowledge of its presence and was merely driving the vehicle. It is further submitted that the petitioner is neither the owner nor the Driver of the vehicle and has no criminal antecedents.

Case No.116 of 2019, G.R. No.2197 of 2019.
