The petitioner seeks bail in connection with Ghosi P.S. Case No. 345 of 2016 instituted for the offence under Section(s) 395 of the Indian Penal Code.
Learned counsel for petitioner has submitted that petitioner is not named in the written report. No recovery has been made from possession of this petitioner. The name of this petitioner has come during investigation in the confessional statement of co-accused Rakesh Paswan @ Langtu. He further submits that petitioner has been remanded in this case from Laheri P.S. Case No. 240 of 2017.
Learned counsel for petitioner has further submitted that other co-accused persons, namely, Shankar Manjhi and
Patna High Court CR. MISC. No.1163 of 2019(3) dt.28-03-2019 2/2 Rakesh Paswan @ Langatu @ Rakesh Paswan @ Langur have already been granted bail by co-ordinate Bench of this Court vide orders passed in Criminal Miscellaneous Nos. 4109 of 2017 and 8527 of 2017 respectively.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Jehanabad in connection with Ghosi P.S. Case No. 345 of 2016, subject to the condition that both the bailors shall be the close relative of the petitioner.
