The petitioner seeks bail in connection with Gaurichak P.S. Case No. 263 of 2017 for the offence under Sections 302, 120B, 34 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the other co-accused persons namely Bablu Kumar and Guddu Kumar and Baua Rai, having more or less similar allegations have been granted bail by different co-ordinate Benches of this Court in Cr. Misc. No. 63049 of 2017 and Cr. Misc. No.63599 of 2018 and the case of this petitioner stands on

Patna High Court Cr.Misc. No.1059 of 2019(2) dt.25-01-2019 2/2 similar footing. The petitioner is rotting in custody since 07.12.2018.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-Patna City in connection with Gaurichak P.S. Case No. 263 of 2017.
