The petitioner seeks regular bail in Bettiah Muffasil P.S. Case No. 729 of 2013, registered for the offences punishable under Sections 307, 302 and other allied Sections of the Indian Penal Code.

The informant named eight persons and alleged that all the accused persons assaulted him. Thereafter the accused persons assaulted Manoj Mahto who died during treatment. The post-mortem shows that Manoj Mahto got only one injury on his head but who is author of the injury has not been disclosed. It is submitted by the petitioner that petitioner was granted anticipatory bail vide order dated 11.08.2014 passed in Cr. Misc. No. 22691 of 2014 but since the petitioner has got criminal antecedent he could not furnish his bail bonds. Petitioner is in jail

Considering the facts aforesaid and the fact that no specific allegation of assault is made against the petitioner, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran, Bettiah in connection with Bettiah Muffasil P.S.
