JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-11-2017 Heard learned Counsels for the petitioner and respondentState. The present Writ application has been filed for a direction to respondent no.3, the Sub-Divisional Officer (West), Muzaffarpur, to dispose of Case No.187/2013, whereby, a proceeding under Section 133 of the Cr. P.C. was initiated for removal of the encroachment.

Considering the nature of prayer made in the Writ application and the nature of order this Court intends to pass, this Court is not inclined to adjourn the matter for filing of the counter affidavit on behalf of the respondent-State or issuance of notice to private respondent no.5, namely, Vijay Singh. It is expected from respondent no.3, the Sub-Divisional Officer(West), Muzaffarpur, to dispose of the proceeding of Case No.187/2013, if it has not already been disposed of, within

Patna High Court CWJC No.6057 of 2017(2) dt.07-11-2017 2/2 a period of three months, after giving due notice to all the affected persons in accordance with law.

The Writ application is, accordingly, disposed of with the aforementioned direction.
