JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 10-01-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as the learned APP for the State.

The petitioner apprehends his arrest in connection with Bind P.S. Case No. 46 of 2020, registered for the offences punishable under Sections 341, 323, 353, 504, 506 of the Indian Penal Code. The informant who is an employee of Block Office lodged this case against the petitioner who is the husband of the Block Pramukh. The allegation against the petitioner is that he entered into the office thrown the papers and assaulted the informant. He also threatened to kill the informant.

Learned counsel for the petitioner has submitted that several complaints were coming against the informant before the

No.13225 of 2021(2) dt.10-01-2022 2/2 wife of the petitioner by the local people and in this respect she went to block and enquired about the matter then the informant became aggressive. The wife of the petitioner has made complaint against the informant to the SDO as well as DM, Nalanda on telephone and just to save his skin the informant has filed this case. Considering these facts and circumstances, let the petitioner be released on anticipatory bail in the event of his arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Barh, Nalanda in connection with Bind P.S. Case No. 46 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. with further condition that at the time of surrender the petitioner shall furnish an affidavit that he shall not indulge in similar type of occurrence in future.

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey , J) SONALI/- U T
