The petitioner is languishing in custody since 07.10.2014 in a case registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code. The accusation is of committing theft in the house of the informant. The name of the petitioner sprang up on his self confessional statement. Though, from the house of the petitioner Lap-top, Nokia mobile, Dongle and Timex watch were recovered.
It is submitted by learned counsel for the petitioner that recovered articles does not tally with the alleged stolen articles as the informant has alleged in the FIR that Sonata watch was stolen whereas the recovery is of Timex watch.
Patna High Court Cr.Misc. No.1460 of 2015 (02) dt.15-01-2015 2/2 A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Dehri-On-Sone, District - Rohtas in connection with Rohtas P.S. Case No. 139 of 2014.
