JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-07-2016 Heard learned counsel for the petitioner as well as learned counsel for Economic Offences.

Petitioner seeks bail in a case registered under Sections 8/20/(b) (ii) (c), 25/29 of N.D.P.S. Act The trial court has reported that charge was framed on 10.2.2016 but up till now, not a single prosecution witness has been examined.

The petitioner was caught when he was carrying Ganja in the truck which was being driven by him and earlier the prayer for bail of the petitioner was rejected by this Court. Considering the report of the trial court as well as allegation levelled against the petitioner, I am not inclined to

Patna High Court Cr.Misc. No.10221 of 2016 (3) dt.27-07-2016 2/2 release the petitioner on bail. Hence, his prayer for bail in connection with Special Case No.39 of 2014 arising out of Economic Offence P.S. Case No.26 of 2014 pending in the court of Additional Sessions Judge VI, Patna stands rejected. However, the learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible. The learned A.P.P. appearing for Economic Offences assures this Court that she will inform the concerned official for production of prosecution witness before the trial court.
