1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Mashrakh P.S. Case no.578 of 2024, registered under sections 123, 105, 110, 61(2) and 3(5) of the Bhartiya Nyaya Sanhita, 2023 and sections 30(a), 33, 34(a), 34(b), 37(A), 37(B), 47 and 34 of the Bihar Prohibition and Excise Act, 2016.
3. As per the prosecution case, on persons having consumed spurious liquor, a number of persons fell ill while two of them died.
4. Learned Senior counsel appearing for the petitioner submits that the petitioner was not named in the FIR. She was falsely implicated in course of investigation. It is submitted that the only material that has transpired in course of investigation

No.3461 of 2025(4) dt.09-06-2025 2/3 are in paragraph nos. 8 and 17 of the case diary which have been reproduced in the order of the learned trial Court wherein the family members of the deceased are alleged to have stated that they had consumed the spurious liquor on purchasing the same from the petitioner. With respect to the statement made by Meena Devi in paragraph no.8 of the petition, it is submitted that she is on inimical terms with the petitioner herein. The petitioner has no criminal antecedent and is in custody since 6.12.2024. It is further submitted that a number of co-accused have been enlarged on bail vide orders dated 18.2.2025 passed in Cr. Misc. no.879 of 2025, dated 24.2.2025 passed in Cr. Misc. no.88541 of 2024, dated 17.2.2025 passed in Cr. Misc. no.88367 of 2024 and dated 25.2.2025 passed in Cr. Misc. no.4100 of 2025. The petitioner undertakes to cooperate in the case/trial.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the material that has transpired in course of investigation and especially paragraph nos. 8 and 17 where the deceased are said to have told their family members about having purchased the spurious liquor from the petitioner herein, the Court is not inclined to

7. Liberty is granted to the petitioner to renew her prayer for bail after framing of charge.
