The petitioner seeks bail in connection with Motihari Town P.S. Case No.480 of 2013 registered under Sections 457 and 380/411 of the Indian Penal Code pending in the court of the Chief Judicial Magistrate, Motihari, East Champaran. Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. but the seizure list disclosed that the theft motorcycle of the informant has been recovered from the courtyard of the house of the petitioner. Petitioner also carries criminal antecedent of 12 cases registered under Section 379 of the Indian Penal Code which is evident from
Patna High Court Cr.Misc. No.9169 of 2016 (2) dt.29-03-2016 2/2 paragraph-3 to this application.
Having regard to the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, the prayer of the petitioner for grant of bail stands rejected. (Rajendra Kumar Mishra, J) P.S./- U T
