Case No.67 of 2019 registered for the offence punishable under Sections 413/414/467/468/471 of the Indian Penal Code and Sections 30(a), 30(b), 30(c) of Bihar Prohibition and Excise Act, 2016.

There is recovery of 10 litres of illicit liquor from the motorcycle of the co-accused. Several persons are named in the F.I.R. including the petitioner. It further appears that he is accused in one more case.

Submission of learned counsel for the petitioner is that nothing has been recovered from his conscious possession. The alleged liquor and motorcycle does not belong to the petitioner. He is in custody for more than three months. Charge sheet has already been submitted in this case as such there is no

In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Bettiah, West Champaran in connection with Sathi P.S. Case No.67 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
