Petitioner seeks bail in connection with Begusarai Town P.S. Case No. 163 of 2015 registered for the offences punishable under Sections 302, 120(B)/34 of the Indian Penal Code. Accusation is that the petitioner and other co-accused either killed or got killed the son of the informant who was found hanging with the rod of window to grab the property. Submission is that the informant has filed petition in the court below on 06.04.2015 stating innocence of the petitioner and others and in this case considering all these things co-accused Sumitra Devi has been allowed pre-arrest bail vide Cr. Misc. No. 6075 of 2016 and the petitioner is suffering in custody since 17.12.2015 to which learned APP fairly submits that co-accused
Patna High Court Cr.Misc. No.6575 of 2016 (2) dt.25-02-2016 has been allowed pre-arrest bail.
In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 163 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
