10-06-2020 Heard learned counsel for the parties through video conferencing.
The petitioner seeks bail in Khagaria P.S. Case No. 875 of 2019, G.R. No. 3421 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
As per prosecution case, 10 pieces of cough syrup of 100 ml. and 8 pieces of foreign liquor of 180 ml. from a plastic bag are said to have been recovered from the hut of the petitioner.
It is submitted on behalf of petitioner that petitioner has falsely been implicated and nothing has been recovered from the possession of the petitioner as also petitioner has no concern either with illicit liquor or hut. It is further submitted that save and except suspicion, there is nothing against
Patna High Court CR. MISC. No.2782 of 2020(3) dt.10-06-2020 2/2 petitioner.
However, from perusal of the seizure list, it appears that recovery has been effected from the hut of the petitioner and petitioner has also got criminal antecedent, I am not inclined to extend the privilege of anticipatory bail to the petitioner.
