In this case, the petitioners are seeking regular bail in connection with Nokha P.S. Case No. 398 of 2022, registered for the offences punishable under Sections 420, 414, 34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise (amendment) Act, 2018.

The learned counsel for the petitioners has submitted that the petitioners are under custody since 16.10.2022 for the allegation that 150 litres of country-made liquor was recovered from their possession.

Considering the above-mentioned facts and

No.5289 of 2023(2) dt.29-04-2023 2/2 circumstances and also considering the period of custody, let the petitioners, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 2-cum-Additional District and Sessions Judge, Rohtas at Sasaram in connection with Nokha P.S. Case No. 398 of 2022, subject to the following conditions:- (i) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.

(ii) If the petitioners are found involved in future in the similar type of offense, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioners and the learned court below will take decision in accordance with law.
