2. The petitioners apprehend their arrest in a case registered for the offence under Sections 191(2), 115(2), 74, 76, 351(2), 352 & 79 of the Bhartiya Nyaya Sanhita and Sections 3, 4 & 5 of Prevention of Witch (Daain) Practices Act.
3. As per F.I.R., these petitioners & other co-accused persons are alleged to have committed abuse and assault with informant & her family members. Accused persons also removed hair of informant and called her Daain (witch).
4. Learned counsel for the petitioners submits that as per F.I.R. itself, specific accusation of assault and removing hair of informant is against co-accused Sheikh Saddan and Shibu. So
Patna High Court CR. MISC. No.2229 of 2025(2) dt.12-02-2025 2/2 far as petitioners is concerned, there is general and omnibus allegation. Petitioner nos. 1 to 4 have got clean antecedent, whereas petitioner no. 5 has got one criminal antecedent, in which, he is on bail.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bikramganj (Rohtas) in connection with Dawath P.S. Case No. 339 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
