JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-01-2020 This is an application for grant of anticipatory bail in connection with Cr.R. No. 61 of 2019, arising out of T. R. No. 323 of 2019, disclosing offence under Section 498A of IPC. Petitioner happens to be the husband of the complainant. There is allegation of demand as well as torture. It further appears from the impugned order that complainant was ready to reside with the petitioner, but he has not taken her. Submission of the learned counsel for the petitioner is that he is ready to keep her with full dignity and care. The allegation is false and concocted.

No.3571 of 2020(2) dt.21-01-2020 2/2 Having heard both sides, in view of the conduct of both the parties, I am not inclined to grant privilege of anticipatory bail to the petitioner. Petitioner is at liberty to persuade the opposite party no.2 and if she agrees to live with him, he has to appear before the court below along with the opposite party no.2 and make prayer for regular bail, the learned court below shall consider the aforesaid aspect of the matter, while deciding his bail application.
