JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-01-2015 Petitioner is languishing in custody since 10.10.2014 in a case registered for the offences punishable under Sections 366A/34 of the I.P.C.

It is alleged that petitioner being tutor of the daughter of the informant kidnapped her.

It is submitted by learned counsel for the petitioner that the victim in her 164 Cr.P.C statement got her age recorded as 17 years whereas the Court has assessed her age as 16 years, where she stated that she of her own went in the company of the petitioner and married with the petitioner. The medical report suggests the age of the victim approaching 18 years where no evidence of sexual intercourse has been found.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the

Patna High Court Cr.Misc. No.2298 of 2015 (3) dt.29-01-2015 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Jagdishpur P.S. Case No. 151 of 2014.
