The petitioner seeks regular bail in connection with Bisfi P.S.Case No.364 of 2019 dated 26.11.2029, G.R.No.2267 of 2019 registered for offences punishable under Sections 272, 273, 353/341 and 323/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016 . There is recovery of 68 ltrs. of liquor from the house of the co-accused and the petitioner is also named in the FIR. Submission of the learned counsel for the petitioner is that petitioner has been falsely implicated in this case, there is no recovery from his possession or at his instance or from his house. He is in custody for two months and he has no criminal antecedent..

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd ADJ cum Special Judge (Excise Act), Madhubani in connection with Bisfi P.S.case No.364 of 2019 dated 26.11.2029, G.R.No.2267 of 2019.

With the aforesaid observation, this application is allowed.
