The petitioner seeks bail in a case registered for the offence punishable under Sections 304(B), 498(A) and 34 of the Indian Penal Code.
Petitioner in association of his family members used to torture the daughter of the informant and ultimately she has been killed for non-fulfillment of dowry demand. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He submits that petitioner is the father-in-law of the deceased. He submits that there is no specific overt act against the petitioner. He submits that husband of the deceased is already in judicial custody since 27.07.2021. He further submits that petitioner bears no criminal antecedent as stated in para-3 of
Patna High Court CR. MISC. No.13408 of 2021(3) dt.27-09-2021 2/2 the bail application and he is languishing in judicial custody since 23.08.2020.
Considering the facts and circumstances of the case and the fact that husband of the deceased is already in judicial custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Musrigharari P.S.
