JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-02-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Turkauliya P.S. Case No. 564 of 2018 for the offence under Sections 401 and 414 of the Indian Penal Code. Learned counsel for the petitioner submits that the allegation against this petitioner is that he was apprehended along with stolen motorcycle and on demand of document he has not been able to produce the same relating to ownership of the motorcycle. He further submits that the petitioner has purchased the said motorcycle, but he has no knowledge that the motorcycle is stolen one. The petitioner is in custody since 30.08.2018.

Considering the fact that the petitioner has remained

Patna High Court Cr.Misc. No.1256 of 2019(2) dt.05-02-2019 2/2 in custody for more than five months, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Turkauliya P.S. Case No. 564 of 2018.
