The petitioner apprehends his arrest in connection with Baheri P.S. Case No. 230 of 2020 registered under Section 30(a)/ 41 of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Only on the confessional statement of co-accused, petitioner has been made accused. Further submission is that the vehicle did not belong to the petitioner and the petitioner has no concerned with the alleged recovery of wine and vehicle. It is also submitted that petitioner has no criminal antecedent.

Having considered the facts and circumstances of the

No.12983 of 2021(2) dt.22-10-2021 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the 2nd Additional Sessions Judgecum-Special Judge (Excise Act), Darbhanga in connection with Baheri P.S.
